Terms of Service

Welcome to Finding Eve. These Terms of Service ("Terms") govern your access to and use of the Finding Eve mobile application and related services (the "Service"), operated by Finding Eve ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Finding Eve. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. We may request proof of age at any time and reserve the right to terminate accounts that do not meet eligibility requirements.

2. Account Registration

• You may create an account using Apple Sign-In, Google Sign-In, or phone number verification.
• You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You may not create more than one account, transfer your account, or use another person's account without permission.

3. User Conduct

You agree to use the Service respectfully and lawfully. The following are strictly prohibited:

• Harassment and abuse: Threatening, bullying, intimidating, or harassing other users in any form.
• Hate speech: Content that promotes hatred, discrimination, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
• Fraudulent activity: Impersonating another person, using fake photos, catfishing, or misrepresenting your identity.
• Inappropriate content: Sharing sexually explicit, violent, or otherwise offensive material.
• Spam and solicitation: Sending unsolicited advertisements, promotional material, or commercial messages.
• Illegal activity: Using the Service for any purpose that violates applicable laws or regulations.
• Minors: Soliciting or communicating with anyone under the age of 18.
• Technical abuse: Attempting to reverse-engineer, hack, disrupt, or exploit the Service or its infrastructure.

4. Content

4.1 Your Content

You retain ownership of the content you submit to Finding Eve, including photos, bio text, and messages ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service.

4.2 Content Moderation

We reserve the right to review, remove, or restrict access to any User Content that violates these Terms or our community guidelines. We may use automated systems and human review for content moderation and safety purposes.

4.3 Reporting

You may report users or content that violates these Terms. We will review reports and take appropriate action, which may include warnings, content removal, temporary suspension, or permanent bans.

5. Matchmaking and Interactions

• Finding Eve uses AI-assisted systems to evaluate compatibility and suggest matches on your behalf, rather than manual swiping. Recommendations are based on your profile, preferences, and compatibility factors. We do not guarantee any specific outcomes, matches, or relationships.
• You are solely responsible for your interactions with other users. We are not liable for any disputes, damages, or harm arising from user interactions, whether online or offline.
• Exercise caution and good judgment when communicating with and meeting other users. We strongly recommend meeting in public places for initial in-person encounters.

6. Identity Verification

We may offer or require identity and selfie verification to help maintain trust within the community. Verification indicates that a user has completed the verification process; it does not constitute an endorsement, background check, or guarantee of any user's identity, intentions, or character.

7. Subscriptions and Payments

• Finding Eve may offer premium features through in-app purchases or subscriptions.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Payments are processed through Apple App Store or Google Play Store and are subject to their respective terms and refund policies.
• We reserve the right to modify pricing and features at any time.

8. Push Notifications

By using the Service, you consent to receive push notifications related to matches, messages, and service updates. You may disable push notifications through your device settings at any time.

9. Intellectual Property

The Service, including its design, features, code, logos, and branding, is owned by Finding Eve and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

10. Account Suspension and Termination

• We may suspend or terminate your account at our discretion if you violate these Terms, engage in behavior that is harmful to other users, or for any other reason we deem appropriate.
• You may delete your account at any time through the app settings. Upon deletion, your profile will be removed and your data will be handled in accordance with our Privacy Policy.
• Bans may be temporary or permanent depending on the severity of the violation.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not conduct criminal background checks on users and make no representations about the character or intentions of any user.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDING EVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Finding Eve and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by other means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you should stop using the Service and delete your account.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
